Markis Shirley is jonesing to get out of jail and will admit to anything; missing documents prevented his stupidity

 


Frequently arrested and convicted felon Markis Shirley had three cases on calendar today.

One case was on for trial confirmation today; jury trial is scheduled for May 24. He has not had a preliminary hearing in another case and has been holding up a package disposition in a third case with two co-defendants.

At the last court hearing, it was mentioned Shirley had two strikes and multiple life sentences in several cases.

His attorney, Mr. Zachary Curtis told Judge Lawrence Killoran that Shirley wanted to admit to his PRCS violation and that the recommendation was 60 days. 

Deputy District Attorney Whitney Timm said,"Prior to the admission, Mr. Shirley needs to be advised the admission maybe used in upcoming trials."

Should have been a simple admission on that case. However due to the chaos that is Humboldt Superior Court these days, there were issues.

Mr. Curtis started to argue with what Ms. Timm was saying until Judge Killoran pointed out that there was a first amended PRCS violation filed December 16 which followed fresh allegations. The recommendation had been crossed out and was 180 days.

That was a surprise to Mr. Curtis. He did not have a copy of the first amended petition nor was he aware his client had been arraigned on  the petition in January 2021. The DA did not have a copy either.

Mr. Curtis asked that trial confirmation be continued so he could advise his client after looking at this new information.

Shirley jumped in and said, "I would like to admit to 180 days."

Mr. Curtis told Shirley that he needs to look at what the allegations are and advise him before any admission.

Further trial confirmation is May 13.

5/13: No deal. The jury trial is procceding and Shirley's PRCS case will be heard concurrently.
