Brian Daniels resolved his four cases today with the dismissal of one cases and misdemeanor pleas in three cases with charges dismissed in those cases.
After a hung jury in one case, Daniels got to plead guilty to one count of brandishing a firearm. Daniels will serve no jail time because he got credit for 1 actual day and credit for the 30 days at Waterfront Recovery and 1 year informal probation. He had a $70 fine, a $150 restitution fine and a booking fee of $206 in that case.
In another case, his original DUI charge was reduced and he pleaded guilty to a "wet and reckless"; restitution reserved and he pleaded guilty to the hit and run charge.
Deputy District Attorney Roger Rees appeared today in court for the People since Deputy DA Luke Bernthal is in trial. Mr. Rees told Judge Kelly Neel "there were issues of proof" since Daniels did not submit to blood test.
In another case, Daniels entered a guilty plea to driving under the influence. By law, it was required so he got three years probation in this case. A $70 fine, $150 restitution and because it is required by by law, a $1,000 fine. He has to participate in a DMV multi offender program.
Daniels got a further break by remaining being charges dismissed in the three cases. He gets to keep any firearms needed for work. Daniels has to write letters of apology to the two victims in the recent trial for his conduct.
Daniels is supposed to move to Missouri at the end of the month to join his wife who is stationed there with the air force.
Judge Neel told Daniels,"I am doing this in part in recognition of your getting your act together and for being a member of the National Guard."
Is he apologetic and has he turned his life around, time ? Time will tell. He mumbled some words which did not sound sincere but more like, I have to apologize. Judge Neel was helpful in mentioning Missouri weather and the consequences of breaking the law there and it was hard to hear but Daniels did not seem grateful.
We can thank the members of the hung jury for yet another local brat with generational connections and law enforcement ties thinking "boys will be boys and getting away with a slap on the wrist. They, by law, do not know about Daniels' history. They may now.
Ms. Christina Rosenfeld and Ms. Joanna Cloutier expressed accurately how many feel about the no consequences and rampant crime in Humboldt. Criminal justice reform would be due process, fair trial and equal treatment for all defendants.

5/13: The court clerk noticed that an old plea form had been used in the two DUI cases and Judge Neel calendared a hearing so Daniels could be given the Watson advisement.
