35 minutes to cover a plea in court while jurors wait

 


Kidnapping, robbery and assault suspect Franklin Molina was scheduled for an entry of plea today. The last hearing was continued because there was no interpreter. It took 35 minutes for Deputy Public Defender Casey Russo and the interpreter to go over the plea, in court. 

This delay meant jurors waiting in a hallway. Judge Kaleb Cockrum respecting their time mentioned that to the attorneys.

As I previously reported, the plea deal is for a nine year stipulated prison term. Molina waived all custody credits up to April 16 and waive his apellate rights. Molina only has 19 actual days of custody credits.

Molina pleaded guilty to Counts 1 to 5 and a special allegation, PC 12022. 5 (a) personal use of a firearm.  Molina will be sentenced to the aggravated term of 6 years for Count 1; 6 years for Counts 2-5 to be served concurrently and the low term of three years for the special allegation. Remaining charges and special allegations were dismissed.

Count 1, robbery; Counts 2 and 3 False imprisonment; Count 4 assault with a firearm and Count 5 criminal threats.

Deputy District Attorney Trent Timm appeared on the case for the People. Sentencing is on May 25.

5/25: Molina waived over 800 credits and was sentenced to the 9 years negotiated prison term.

Livestream started very late, it was very hard to hear Judge Cockrum. There was back and forth about the credits numbers so I am not going to put the exact amount. There were fines. As I have noted many times, no direct access to court records and issues with livestream, after 14 months of putting too much extra time on several cases, if someone wants exact information on credits and fines they can go down to the Courthouse.
