19 year old had two 2023 cases dismissed & he thanks his attorney by getting arrested on new charges

19 year old Carlos Ariel Martinez-Gutierrez was arrested by Eureka Police Department yesterday for PC 148 (a) (1) resisting arrest, HS 11378 possession of meth with intent to sell and HS 11351 possession for sale of a controlled substance; cocaine.

Carlos is a moron. He had two 2023 cases, both dismissed by the DA. The case that was dismissed on 3/19/24, the DA was going to refile. As of yesterday, I checked in e court and with the DA's office and charges had not been refiled. Getting arrested is not the way to thank your previous attorney, Ms. Andrea Sullivan. You two breaks that most defendants would be grateful for; especially people at a young age.

Martinez-Gutierrez was arraigned on 4/18 on three counts. HS 11378 possession of meth with intent to sell and HS 11351 possession for sale of a controlled substance; cocaine are charged as felonies and PC 148 (a) (1) resisting arrest as a misdemeanor. The complaint alleges that Martinez-Gutierrez attempted to sell these drugs to a 14 year old.

The Public Defender's office was appointed to represent him, bail set at $35,000 by Visiting Judge Doris Shockley. OR/bail on 4/22; preliminary hearing on 4/30.

4/22: Supervised release granted by Retired Judge Christopher Wilson. 4/30 date vacated. Preliminary hearing rescheduled for 6/4.

Martinez-Gutierrez had a 2016 juvenile case on the 4/19 calendar. Juvenile cases and records are confidential. Unless there is a change and those records are made acessible and if they are relevant or mentioned in the current case, I have no reason to check that case.
