John Chiv: DA's office did not inform or serve defense of crucial filings in criminal case

The Humboldt County District Attorney's office filed an opposition to the defense motion to suppress on 12/16. The DA's office also filed a request for an in camera hearing on 12/20/21. There is no proof of service filed for either document.

I spoke to Mr. Richmond on 12/22 and asked him if he had received any paperwork including any opposition/responses. He had no idea of either filing by the DA's office and found this out through me just now.

The courts are closed on 12/24 and the weekend. The clerk's office closes at 2 p.m. The hearing is on 12/27 in the morning.

Are there special court rules for the Humboldt County District Attorney's office?

If Judge Gregory Elvine-Kreis has been assigned to Ray Christie's case for all purposes, why is the 12/27 hearing listed on the master calendar? The online calendar is still showing December 23. It did not change to December 27; no one bothered to check and no one can be reached until Monday. This has happened before and if it is a holiday, it is a given, things will be screwed up.

I checked e court around noon today. They have assigned the trial confirmation and jury trial to Courtroom 3 which will be Judge Elvine-Kreis' courtroom starting 2022.

Based on the current trial dates, the D.A.'s office has a December 30 deadline to provide discovery to defense. Based on their ongoing behavior in this case, why should anyone believe they will meet that obligation.

Humboldt government, law enforcement, politicians, agencies and Humboldt courts do whatever they like. In this case, the arrogance and the Humboldt way is blatant and embarassing.

I don't want to hear anything about rules and procedure from Humboldt Superior Court or the Humboldt D A.'s office if they don't even follow basic courtesy, professionalism, the Constitution or their own rules.
