California issues first ruling allowing a worker's lawsuit against an employer over a family member's COVID death

The California Court of Appeal, Second Appellate District, ruled that South San Francisco based California See's Candies' must face a lawsuit by an employee who says she caught COVID-19 at work, then gave it to her husband which resulted in his death.

According to Reuters, this is the first ruling allowing a worker's lawsuit against an employer over a family member's COVID death.

The judges rejected See's Candies' argument that the employee, Matilde Ek, must file for workers' compensation rather than seek damages in court because her husband's death was "derivative" of her own workplace injury.

A lawyer for the Berkshire Hathaway Inc-owned  company had no immediate comment. A lawyer for Ek could not immediately be reached for comment. The U.S. Chamber of Commerce, which had filed lbrief supporting See's Candies could also not be reached for comment.
