John Chiv: HCSO and DA, "you've got some 'splaining to do"

This is installment #2 of a post I did earlier about the Ray Christie case. The defense has filed a motion to dismiss criminal charges against Christie or as an alternative are asking for suppression of evidence from a March 2018 raid as a sanction because the People failed to preserve exculpatory evidence.

Trial confirmation and the jury trial are scheduled for next month and so far the People and the Court have not been cooperative about a continuance.

In this post is information from two declarations from Christie's attorney Mr. Rick Richmond, the motion and a declaration from a forensic investigator.

Mr. Richmond remarks were brief as the filings are detailed.

"Humboldt County Sheriff's Office has a written policy that when you do a raid, only official cameras are to be used," said Mr. Richmond. "You come back, take out the memory card and put it into evidence. You never use personal cameras unless it is an extreme emergency."

Forensic investigator's declaration:

There are a lot of issues with this retrial, this case and a lot of information in recent posts so if you have not been following the coverage regularly; you will have to catch up and read previous posts. I have now said this several times. Regular readers read the blog daily, several times daily and know to follow cases of interest consistently.
