"All my time is being spent in non time waived matters"



Preliminary hearing for GOP vandalism suspect Michael Valls was scheduled for September 1. It was reset to October 27.

Valls is charged with second degree burglary, vandalism of the local GOP office and two counts of resisting/obstructing a police officer.

Deputy Conflict Counsel April Van Dyke is Valls' attorney. He has a 977 waiver of personal appearance on fil and was not present today. Deputy District Attorney Roger Rees is the prosecutor for the case. People have one witness. Deputy DA Trent Timm appeared today on the case for the People since Mr. Rees is currently in a jury trial and had closing arguments this morning.

During the informal call, it was anticipated there would be a continuance. Valls has waived time.

"All my time is being spent in non time waived matters," said Judge Kaleb Cockrum. Earlier today, on another case, he mentioned all available space had been taken up this week.

Time estimate by the People was 30 minutes. At the last hearing, Judge Kaleb Cockrum set aside 1 hour, 15 minutes to allow for ample time for cross examination by defense.

Valls wants to be personally present.
