The People are not seeking the death penalty for Demetrius Coleman; they are seeking life without parole


Murder suspect Demetrius Coleman's jury trial is scheduled for September 28 .

The People filed a motion to amend the information. That motion was granted today by Judge Timothy Canning since defense "submitted" on the motion.

The People are not seeking the death penalty in the case; they are seeking life without parole.

Ms. Andrea Sullivan is Coleman's attorney. Deputy District Attorney Carolyn Schaffer is the prosecutor for the case.

Coleman was  originally  charged with murder and special allegation that he personally and intentionally discharged a firearm which caused great bodily injury or death to Johnny Renfro.

In the first amended complaint, there are additional special allegations. Count 1 PC 187 murder. First special allegation is PC 12022.53 (d) intentional discharge of a firearm; second special allegation is PC 190.2(a) (21) murder was intentional and perpetrated by means of discharging a firearm from a motor vehicle, ; third special allegation is PC 667 (b) (1) prior conviction of a serious and violent felony; fourth special allegation is PC 667 (b) (1) and fifth special allegation is PC 667 (a) (1).

Coleman has a prior conviction from Minnesota and a prior conviction from Butte County that is listed in the complaint.

PC 667 (a) (1): "Any person convicted of a serious felony who previously has been convicted of a serious felony in this state or of any offense committed in another jurisdiction which includes all of the elements of any serious felony, shall receive, in addition to the sentence imposed by the court for the present offense, a five-year enhancement for each such prior conviction on charges brought and tried separately.  The terms of the present offense and each enhancement shall run consecutively."
