Another continuance, disqualification or will the Acosta/Carroll preliminary hearing proceed today?




Preliminary hearing is scheduled today for local attorney Michael Acosta and Sarah Carroll. Retired Judge John Feeney is the latest Judge assigned to the case.

No idea if this preliminary will proceed today. If it does, I am at the Mark Dare trial and so will follow up the best I can.

Acosta is representing himself. Ms. Andrea Sullivan is Carroll's attorney. They were in court. Carroll appeared via Zoom.

Count 1 is Maintaining a place for Selling or using controlled substances. Count 2 Possession for sale of a controlled substance; heroin. Count 3 is Posession for sale of designated controlled substance; alprazolam.

Judge Gregory Elvine-Kreis was disqualified after Acosta exercised his right to 170.6. Four Humboldt Superior Court Judges; Judge Lawrence Killoran, Judge Kelly Neel, Judge Christopher Wilson and Judge Kaleb Cockrum have all recused themselves from the case.
