Defense expert can testify about motivation of child molestors and those who watch, distribute or produce child porn
After the jury was excused today, Judge Kaleb Cockrum addressed scheduling and a ruling he made yesterday.
When Detective Rowberry testified and he was asked about motivation of child molestors and those who watch, produce or distribute child pornography, Judge Cockrum ruled that Detective Rowberry was not an expert on that subject.
This was a limited 352 ruling. The defense's expert who did the psychological evaluation of Mark Dare will be allowed to testify on the subject. Previously, Judge Cockrum granted the People's motion that their expert can watch testimony of this defense expert.
There is one more witness the People intend to present on September 28. However, there is a possibility that a defense expert witness may appear via Zoom. Judge Cockrum asked unless Monday is the only time the defense expert can appear, that Public Defender Marek Reavis reschedule that witness.
Although Deputy District Attorney Whitney Timm addressed this while it happened, just to make sure, today she asked that in the instances that Jane Doe #1 and Jane Doe #2's real names were inadvertently mentioned on record, that they be stricken.
Mr. Reavis mentioned one name. Today, Jane Doe #1 and Jane Doe #2's father mentioned the name during emotional testimony.
After the People rest their case, the defense gets to present their case, if they chose to do so. At least, one expert witness and Windy Dare are expected to testify for the defense.
