William Whipple charged with assault with a deadly weapon other than a firearm and prior conviction of serious, violent felony


William Whipple is scheduled to be arraigned this afternoon. Count 1 is PC 245 (a) (1), assault with a deadly weapon; a knife.

There are two special allegations for Count 1.  One is for PC 12022. 7 (a), inflicting great bodily injury and the other for PC 667 (b) -(i),prior serious and violent conviction.

Whipple has a parole hold.

Update after court hearing:

At the hearing, Judge Lawrence Killoran mentioned "juvenile adjucation" regarding the PC 667 (b) -(i) special allegation.

Deputy District Attorney Steven Steward appeared at arraignment for the people. Since Whipple is "on active probation" and was last represented by the Public Defender's office; Mr. Ben McLaughlin accepted appointment for his office. Whipple's attorney will most likely be Deputy Public Defender David Celli based on his name.

A petition for violation has not been filed yet so Mr. McLaughlin asked for a referral to supervised release.
Bail, according to schedule,  was set at $120,000.

OR/bail hearing is on September 18; preliminary hearing is on September 29. Time was not waived.

9/18: Whipple remains in custody. As I mention in the post above, he has a parole hold.
