Hearing on a 995 motion in vehicular manslaughter and DUI suspect Gary Cudney's case was scheduled for September 17. Cudney is charged with the death of Dwight Davis aka "Dirty Dave.
Deputy District Attorney Steven Steward is the prosecutor for this case. Mr. Manny Daskal is Cudney's attorney.
At the last hearing, defense had mentioned records subpoenaed from the VA. Several medical documents from the VA were given to Mr. Daska. Mr. Steward stipulated to chain of custody.
After both the defense and People review the records, further decision will be made regarding the 995.
Judge Lawrence Killoran scheduled setting of jury trial and hearing on the 995 motion for 10/23.
