Eric Kirk is representing Kim Bergel; she is opposing Loewenstein's request for attorney fees


I was able to view the recent filings in Eureka Councilmember Kim Bergel's case against Cornelius Loewenstein. I am not going to ppost this entire document or all the pleadings.



Several points in Bergel's pleadings are a rehash of the lawsuit on the restraining order by Bergel, which was denied by Judge Neel. This time, Bergel has  Eric Kirk to represent her, as of September 8. On Bergel's behalf, Mr. Kirk filed an opposition to the request for attorney fees on September 11

One of the arguments in Bergel's opposition is that the awarding of attorney fees is discretionary.

On behalf of Loewenstein, Mr. Capps is requesting attorney fees per CCP 527.6 (5) and 1033.5 (a) (10) (b)

A hearing for September 25 has been rescheduled to October 23.

    Cornelius is innocent. I am a Trump supporter. Cornelius is a Democrat... Cornelius was driven out of Eureka. No wonder we have so many homeless druggies here.
