995 motion denied for Pamela Millsap; referral made again to Probation for ongoing electronic monitoring


Hearing on a 995 motion and the defense motion for release for murder suspect Pamela Millsap was continued this morning.

The 995 motion was denied. Regarding supervised release, Judge Christopher Wilson referred back to Probation for supervised release with  ongoing electronic monitoring. Ruling on Millsap's release is scheduled for September 14.

Probation had recommended against supervised release.

Trial setting is scheduled for September 23.

Deputy District Attorney Whitney Timm is the prosecutor for the case. Deputy Conflict Counsel April Van Dyke is Millsap's attorney.

Once again, Ms. Timm did not stipulate to release of subpoenaed records from Redwood Regional Center and St. Joseph's hospital. Defense will be provided the documents and will resubpoena them, if neccessary.

The gun is available for defense to have their expert review and examine the firearm.

Millsap is charged in Count 1 with PC 192 (a), voluntary manslaughter. Count 2 is PC 273 (a) (a), child abuse/endangerment with a special allegation PC 12022.7 (a) causing great bodily injury. Count 3 is PC 273 a (a), child abuse/endangerment with special allegation, PC 12022.5 (a), using a firearm in the commission of a crime.
