Ciarah Marquez was arrested on August 19. She was released on 8/23/ per PC 825.
California Penal Code 825 PC requires courts to arraign criminal defendants within 48 hours of the arrest unless they bail out first. Marquez was not arraigned within the required time and therefore released.
Marquez is under the misconception her release from jail means she was found not guilty.
I checked with the Humboldt District Attorney's office. A report was received; it is being reviewed. I also heard back from Assistant Deputy District Attorney Stacey Eads. "A report was received and reviewed by the assigned DDA. Filing of charges is pending further investigation & review."
So,Ciara, no charges have been dismissed against you. They could still be filed and your case is pending. If anything changes, I will add an update to this post.
