Jury selection started yesterday in Aaron Arlotta's fentanyl case. Originally his charges included fentanyl but after the preliminary hearing, the jury trial charges were Count 1 resisting an executive officer and the special allegation of a serious felony conviction
A jury was picked before lunch. Opening arguments, evidence presented and the jury went into deliberations today around 3:16 p.m. Court is dark tomorrow on this case. Deliberations resume Thursday.
In the fentanyl case, Arlotta is charged with PC 69 resisting an executive officer. The complaint states Arlotta "did unlawfully attempt by means of threats and violence to deter and prevent Officer J. Mullen and Officer J. Phinney" from performing their duties. Special allegation for Count 1 is PC 667 (b) through (i) that Arlotta has a prior conviction of a serious and violent felony in 2017 for PC 459/460 (a) burglary.
A probation case is trailing.
Deputy District Attorney Jessica Acosta is the prosecutor for the trial. Conflict Counsel declared a conflict on June 1 and Ms. Andrea Sullivan was court appointed to represent Arlotta. She has been on this case for two months.
Judge Gregory Elvine-Kreis is the trial judge.
