"I am sorry for touching his nuts."

 

Alleged molestor Kevin Dikes was held to answer on all charges after his preliminary hearing on August 10.

Kevin Dikes is charged with kidnapping and molesting a 9 year old boy and 10 year old boy.

Today, APD Officer Officer Kent Falkenstine, Detective Victoria Johnson and Detective Sgt. Chris Ortega testified for the People at Dikes' preliminary hearing. Sgt. Ortega is the lead investigator for this case.

The alleged victim's are  John Doe 1 who was 9 years old at the time of the incident at Dikes' residence on I street in Arcata. John Doe 2 was 10 years old  when the allegations were disclosed and that incident took place in Crescent City. I will refer to John Doe's father as Mr. S without using his full last name which was mentioned in court.

There was a 14 year old male minor at Dikes residence in Arcata the night John Doe was there. He is not a victim. Patricia Lai, a woman who has a room at the residence and was there that night and a woman named Hillary who left later that evening. The women are adults and not related to any victim and like any other witness in any case, their names are a part of public record. 

Det. Johnson testified that "Kevin" told John Doe's father "he was sorry." Mr. S. asked Dikes what he would like to say to John Doe. Dikes said he would tell John Doe 1 "I am sorry for touching his nuts." Mr. S said he wanted Dikes to say "he was sorry for violating John Doe's trust."

"Kevin woke up to find his arm around John Doe," testified Det. Johnson. At the time of the touching both were  awake.While touching John Doe, Dikes asked John Doe if he felt the touching was inappropriate.

A CAST interview was conducted the next day by Jed Mefford. Sgt.Ortega testified John Doe said his father dropped him the day before at Dikes residence approximately at 3 p.m. John Doe knew Dikes because the families went bowling and on a camping trip. John Doe played video games and watched movies sitting on the couch in the living room. John Doe gave specific names of movies he watched. "Kevin was sitting next to him. Kevin asked him to sit on his lap. John Doe was not comfortable but he went along with it."

Dikes claimed John Doe wanted to cuddle. Earlier in the evening it was determined that John Doe would sleep the couch. The 14 year old corroborated that when he went to bed around 9 p.m. that John Doe was asleep on the couch under a blanket. At 2:30 p.m. when he went to get a snack, he did not see Dikes or John Doe.

That evening, the 14 year old and Lai both went to their rooms to sleep around 9 and 10 p.m. Dikes had his own room. There was no door to the room but there was a covering. John Doe had no idea how he ended up in Dikes bedroom.

John Doe said he woke up in Dikes's bed, he was groggy. Dikes massaged his back, moved down to his waist then "Kevin was strumming his butt, groping his butt, strumming his balls and picking at his penis." Dikes slid his finger into John Doe's butt crack. The touching was over clothes. Dikes asked if he could take down John Doe's pants and put his hand down.

John Doe was awake and in Dikes bedroom for two hours. The touching lasted 15 minutes and stopped when Dikes had to go to work. Dikes is a large man and John Doe was a slight, small boy. John Doe said he was afraid of Dikes.

Deputy District Attorney Whitney Timm is the prodecutor. Conflict Counsel Supervising Attorney Meagan O'Connell is Dikes attorney.

Judge Kelly Neel presided over the hearing. Dikes was held to answer as charged. Arraignment on information is on August 24. 

The mother of one of the John Doe's was in court for the hearing.
