I was the only media in the courtroom right now for Joseph Marshall's arraignment for murder and discharge of a firearm. The petition was filed today. I just happened on the second floor checking on the case and it was called in Courtroom 7. This is a juvenile case and it is confidential.There are no court minutes or records accessible in the system to the media or public.
Humboldt Superior Court Presiding Judge Kelly Neel went over juvenile rules, reports and rights with Joseph Marshall. She explained to Joseph Marshall that the process may take time and the reports being ordered and that experts maybe appointed.
DA has filed motion to transfer to adult court. There will be a hearing on 9/4. Deputy Conflict Counsel RJ Leohner was in court with Joseph Marshall. Deputy DA Alison Herson appeared on the case in juvenile court. Senior Deputy DA Roger Rees was also in court and said he was in contact with Leonard Vanwormer's sister and father who were not in court today since transfer to adult court is pending.
HCSO Detectives Brian Buihner and Jennifer Taylor were in court today.
Joseph Marshall is a member of the Yurok Tribe.
A time waiver was entered but Mr. Leohner objected to detention. Judge Neel said Joseph Marshall will be held in juvenile hall until he is 18.
