Pamela Millsap trial rescheduled for next year

 


On June 30, there were three motions scheduled in murder suspect Pamela Millsap's case. 

Deputy District Attorney Whitney Timm is the prosecutor for the case. Deputy Conflict Counsel April Van Dyke is Millsap's attorney. 

The defense filed a motion to continue with a declaration for an in camera proceeding as well as a motion to compel and motion for sanctions. The DA filed an opposition to the motion to compel and Conflict Counsel filed a response. The DA also filed an opposition to the motion to continue. 

"Ms. Timm is making every effort to get discovery," said Ms. Van Dyke. Defense withdrew the motions to compel discovery and motion for sanctions.

Ms. Timm did not object to the motion to continue so it was granted. No in camera proceeding was necessary.

Due to discovery and Ms. Timm's trial schedule, trial confirmation is on June 29; jury trial on July 11.

Ms. Timm will be out on maternity leave in September and returning in March. She already has the Ryan trial scheduled in March. Due to outstanding discovery, Judge Cockrum said defense also needs time to prep.

Ms. Timm was going to check to see if the case could be reassigned but Judge Cockrum said she was specially assigned. Judge Cockrum is familiar with this complex case because he presided over the preliminary hearing.

Defense has subpoenaed Eureka Community School records.

Millsap appeared via Zoom.
