Ryan Tanner enters additional plea of not guilty by reason of insanity

 


Defense motion to continue was granted for Ryan Tanner's murder trial. Tanner entered an additional plea of not guilty by reason of insanity.

Deputy District Attorney Whitney Timm is the prosecutor for this case. Mr. Russ Clanton is Tanner's attorney.

The reasons by defense have already been addressed in previous coverage. Mr. Clanton repeated the 40 People's witnesses and DNA report and "monumental discovery" to Judge Lawrence Killoran. There is a "threat of life without parole for my client," he said. Mr. Clanton said he needed time to prep. Tanner isnow" heavily medicated with anti-psychotic meds" and based on what he was told about Tanner fron the age of 12; he wants doctors to evaluate Tanner for a NGI. Mr. Clanton said this was discussed with Judge Christopher Wilson during "informal intervention" on Friday. Mr. Clanton is not sure how many witnesses he will call, yet. He was fine with a date next year and said that this had been discussed with Tanner andhis family.

"The state of the evidence remains the same as it was in May when this date was set," said Ms. Timm. "In 7 months time with 7 new pieces of evidence," Mr. Clanton is saying he is still not ready. Ms. Timm said in May, the trial date was set based on what Mr. Clanton relayed to the Court. "If the court grants the continuance, I ask for a date to be set that is fair for Mr. Jason Garrett and her family.

Ms. Timm is going on maternity leave in September and returning in mid March. She stated this at the last hearing and Mr. Clanton was aware when the current date was set. Ms.Timm said Mr. Clanton has been Tanner's attorney for "a year and a half." She added it was unfair to ask another attorney from her office "to get ready for this case in such a short time." Ms. Timm said it would take another prosecutor the same amount of time to prepare for this case as it would be if the trial date was set in March.

Trial confirmation is on March 7; jury trial is on March 21.
