Arguments on Judge John Feeney's motion for reconsideration of release of sexually violent predator Joshua Cooley has been delayed by three weeks because the defense filed a motion to continue. It was reset for August 4.
There will be no live testimony; it is a non evidentiary hearing with attorneys presenting arguments. Cooley may or may not be present via Zoom. He is at Coalinga State Hospital.
Conflict Counsel Supervising Attorney Meagan O'Connell said her expert witness cannot meet with Cooley "until late this week", a report then needs to be provided to her which is necessary for her to file "briefs."
Assistant Deputy District Attorney Stacey Eads said her statements were the same as she has stated before. Her summary of what has happened with this case for the last few years was on point.
"We do need to reach a resolution," said Ms. Eads. "This matter has been going on for many years. At this point to recreate history."
Ms. Eads said Cooley has not been amenable to treatment. He won't address the issues. As stated many times in previous coverage and why, Ms. Eads said Cooley "poses a risk if he is placed in the community."
"He was given the opportunity for outpatient supervised release," said Ms. Eads. "No placement can be located for years. This is by circumstances Mr. Cooley created for himself."
No one from Liberty Healthcare was present. Cooley's grandparents were not in court today.
