Ryan Tanner entered a dual plea of not guilty by reason of insanity on June 21. Mr. Russ Clanton thought it had been done in both cases.
His other case was on today so the plea could be entered. Tanner was in court. Should have been simple. It wasn't. The way the minutes are written, it is unclear if Tanner was in court. It says attorney Clanton entered the plea on Tanner's behalf. An attorney does do that even if the client is in court.
The minutes are not neccessarily incorrect. The minutes are usually shorthand and capture key details; if any. The court clerks are very busy and under extreme pressure with doing multiple things live court. Mistakes do happen in minutes but the clerk that day is one of the best.
A defendant has to be personally present to enter a NGI plea so now both cases are scheduled on June 28 when there is a setting of dates and witnesses being ordered back. Judge Kaleb Cockrum is being careful and that is good.
Usually both cases are calendared. Why weren't they? Could it because someone new can't handle the simple job of scheduling?
Mr. Clanton thinks Tanner was present. He maybe correct. I think Tanner was in court but honestly with so many cases, watching a bird eye's on livestream, it is hard to tell and recall.
This is the kind of bs, wasted time by attorneys and court resources on repeat hearings and and why there are too many cases calendared with a constant backlog.
Court administration does not understand the concept of time and organization. They are too busy power tripping over attorneys while collecting a taxpayer paycheck because they need to feel like they are somebody. People who don't work for the government have to maximize every minute to earn money.
These days, Scott, the guy who used to be in charge of juries, is sitting in court for trial assignment taking notes. Mira, who used to be there to assist Kelly Nyberg is MIA. Why? She was good at her job.
Meanwhile Nyberg was doing what she usually does, walk around from courtroom to courtroom and all over the second floor looking important.
I made a reference in a previous post about "pet" favorites of the Presiding Judge, Assistant Presiding Judge, court CEO and the Court operations manager. Ass kissing does pay in the world and it definitely pays under this court administration. Unfortunately in the court system, the consequences incompetence being promoted has more dire consequences than anywhere else. Scott has been all over the second floor lately doing exactly what?
