"I am reluctant to grant the motion with no appearance by the attorney or the client."

 

Defense had filed a motion to continue in Gary Cudney's case. He is the suspect in Dirty Dave's death. It was continued to June 23 because there was no appearance by his attorney, Mr. Manny Daskal for 45 minutes. Cudney is out of custody and was also not present.

Deputy District Attorney Steven Steward is the prosecutor for this case. He is out of the office so Deputy DA Whitney Timm appeared on the case.

Ms. Timm said there was good cause based on open heart surgery. It was not stated who that pertained to but Judge Canning said, "I am reluctant to grant the motion with no appearance by the attorney or the client."

Trial confirmation is scheduled on July 13; jury trial on July 26.

6/23 update: Motion to continue was granted. Deputy Public Defender Adrian Kamada made a special appearance for Mr. Daskal who was in another courtroom. Trial confirmation is on 3/23/22; jury trial 4/4/22.
