Trial confirmation for Gary Cudney was scheduled this morning. Jury trial scheduled for March 1 was vacated. Dates were reset after Mr. Manny Daskal made an oral motion to continue.
Deputy District Attorney Steven Steward waived written since Mr. Daskal had informed him of the request. Mr. Steward objected to the motion. He said it was an old case and the People were ready to proceed.
Mr. Daskal told Judge Lawrence Killoran there were issues with witness availability. Defense is going to hire a different accident reconstructionist. Based on expert witnesses, the time estimate given by defense was one month.
Cudney's mother passed away so Mr. Daskal made a 977 appearance for him today.
Trial confirmation is on July 13; jury trial on July 26.
