Jury trial for Brian Daniels was scheduled for February 8. He has several cases. Criminal threats, DUI, hit and run charges but based on his age, Judge Christopher Wilson is willing to put him on probation.
Judge Wilson is the one who told Rickey Warren, "you want fries with that?" Yet, he seems to think that Daniels should just get off with a slap on the wrist.
Judge Wilson heard the preliminary hearing on the criminal threats case. Is it simply age that gets Daniels the preferential treatment?
Daniels was ordered to be present at trial assignment today and yet Deputy Conflict Counsel R.J. Leohner , Daniel's attorney appeared on his behalf.
Deputy District Attorney Roger Rees appeared on the case for the People.
Daniels has only appeared in court once. Judge Timothy Canning and Judge Kaleb Cockrum have both ordered Daniels to appear in court. Just as other local cases, it isn't always the same Judge at the next hearing or trial assignment.
Today was Daniels lucky day with Judge Christopher Wilson calling the calendar.
This is a small town. We have a lot of made up Humboldt local court rules. I think we should have our own addition of a 170.6 where a local party gets to request a Judge not in Humboldt, Mendocino or Del Norte so the good ole local connections and any bias is eliminated.
It would have made the difference in the Marci Kitchen case and many others.
3/5 update: Daniels is not willing to plead to DUIs. That is one thing holding up resolution of his cases. His jury trial for the felony charge is number 7 and on calendar on March 8 but unlikely to proceed. The misdemeanor cases which include DUI charges are trailing.
