Zoom issues delay testimony of first expert witness in Fiore evidentiary hearing

 (2012 booking photo)

An evidentiary hearing on Brian Fiore's  writ of habeas corpus was scheduled today. Before it started, Judge Christopher Wilson told Fiore his attorney Russ Clanton wanted to talk to him.

Fiore was appearing via Zoom. He is in High Desert State prison. Fiore looks nothing like this old booking photo. Different haircut, slimmer and has a goatee.

Livestream was turned off so a confidential conversation could take place between Mr. Clanton and Fiore. Judge Wilson, Mr. Clanton and Deputy District Attorney Luke Bernthal are having an off record discussion about some issues, including scheduling.

Livestream turned back on. The first expert witness, Dr. Winthrop Smith is having technical issues via Zoom which are being addressed. Other witnesses such as Kris Christie and Dr. Terri Haddix are standing by. Usually witnesses are excluded from viewing other witnesses' testimony but in this case, a request has been granted.

I covered the writ in detail in previous coverage. I Closing arguments concluded at 3:23.  I will add the ruling when it is issued by Judge Wilson.

6/14: Hearing continued to 6/15

6/15: Ruling by Judge Wilson only impacted Count 1. People need to time to check on status of other charges and talk to the victim's family before they make a decision about trial about Count 1. Trial setting is scheduled for July 15.
