Third doctor maybe appointed to evaluate murder suspect Daniella Moore

 


Setting of preliminary hearing scheduled for murder suspect Daniella Moore this morning. She has a probation violation case trailing the 2019 homicide case. 

Deputy Public Defender Casey Russo is Moore's attorney.  Deputy District Attorney Stacey Eads is the prosecutor for this case.

At the last hearing, attorneys had only received one doctor's report; the Court did not have that report from Dr. Erick Hung.  Attorneys and the Court were waiting on a report from Dr. Mikel Matto. Since the last court hearing,  that second report has been provided to the Court and attorneys. Moore has entered a dual plea. The evaluation is for her additional plea of not guilty by reason of insanity.

There was no comment on the reports today. Mr. Russo told Judge Lawrence Killoran, "In my opinion, it would be prudent of the Court to appoint a third doctor. I will continue to confer with Ms. Eads to see if we can agree on that third doctor."

"I understand Mr. Russo's position," said Ms. Eads. "I need a little time to evaluate that possibility." 

Status of NGI and appointment of third doctor is scheduled for March 10; the preliminary for April 29.
