Six motels in Humboldt identified for transient release of Joshua Cooley

 


Sexually violent predator Joshua Cooley had a placement hearing this morning.

I warned the community over and over again in Humboldt about the consequences of the apathy in between hearings. Reacting every time there is a placement in Humboldt and doing nothing else does not solve anything. I told you the pattern, the law, the likelihood that Cooley would be released in Humboldt. You ignored it.

Once again, Judge Feeney put the hearing over. His tentative decision and comments after Deputy District Attorney Stacey Eads' remarks and very vocal opposition by Liberty Healthcare's Dr. Cameron Zeidler was not encouraging. Judge Feeney for the first time said he is "considering the possibility of rescinding any release for Cooley." He could have done this months ago; he didn't.

Transient release was Judge John Feeney's tentative decision. The hearing was put over to March but Judge Feeney denied the DA's request to give notice to law enforcement in Arcata and Fortuna.

Six motels in Humboldt, four in Eureka, one in Arcata and one in Fortuna have been identified.

The DA's office requested transient release be postponed so law enforcement and stakeholders have an opportunity to express concerns about monitoring and public safety issues.

Judge Feeney and Deputy District Attorney Stacey Eads summarized the last four years.

There were stats and concerns and case law cited by Ms. Eads. Stats and concerns mentioned by Dtr. Cameron Zeidler from Liberty Healthcare.

These concerns reitetated the People's concerns about Cooley being dangerous and not engaging in treatment. Dr. Zeidler said that he thought transient release was not an option that was going to be discussed today,; that 75 percent of offenders on the transient release return to the hospital; that  the agreement Cooley signed was for a fixed, long term placement situation and not for transient release;  that there is only one SVP transient release in the state and it has  "tremondously" increased the cost to taxpayers. 

I have covered every hearing live; not via email. This is a confidential hearing. You miss it, there are no minutes and no way to get the date. Others read my coverage, send an email off to the DA. Most likely others will cover the next hearing now that I provided the date and information. This hearing is not easy to cover because it is always scheduled on a morning with multiple cases in multiple courtrooms.
