Defense motion to continue kidnapping, robbery and assault Franklin Molina jury trial was granted by Judge Kaleb Cockrum for good cause.
"DNA cannot be addressed except through an expert," said Judge Cockrum.
Deputy Public Defender Casey Russo is Molina's attorney. Deputy District Attorney Trent Timm is the prosecutor for the case.
Mr. Russo said that the lab packet defense expert needed to review was provided to him late January. The expert received it in February. Mr. Russo spoke with the expert last week and the continuance was based on witness availability.
Mr. Timm made on objection on behalf of the family. He agreed with what Mr. Russo stated but clarified that while DNA linking Molina to the scene was given in January, information about DNA was provided to the defense prior to the request for the lab packet.
Mr. Russo said that he did have information but not what the expert needed for the analysis and report.
Trial confirmation is on March 29; jury trial is on April 12.
