Ruling regarding Richard French's mental health diversion was continued until this morning.
Trial confirmation was also scheduled today. The ruling was continued again by Judge Wilson to trial assignment this Friday because "he wanted to give it more thought." French's jury trial is scheduled for March 1.
Deputy District Attorney Roger Rees is the prosecutor for the case. Mr. Ben McLaughlin is French's attorney.
French's mental health diversion hearing had been continued from February 3 to February 8. There were brief references to that hearing this morning.
Mr. Rees asked Judge Wilson to deny the petition. Mr. McLaughlin said, "If the Court grants the petition Mr. French would get a fresh start in San Francisco."
"This is an easy case to deny mental health diversion," said Judge Wilson. He added that he is taking into considerations points raised by defense, including French's age.
Both Mr. McLaughlin and Mr. Rees agreed that if the petition for mental health diversion was denied; judicial intervention would be helpful.
People's offer to resolve the case is an open plea and time in prison.
