Motion to consolidate may end up resulting in case being dismissed against one homicide suspect

There was on the record discussion, off the record discussion and then on record discussion, again.

Things are uncertain if just one or both defendants' preliminary hearing in the Bailey Perry homicide case is rescheduled. The March 1 court date was not vacated. On that day, the case maybe dismissed against one of the suspects.

The preliminary hearing for one homicide suspect, Travontae Hutson was continued for four weeks. His attorney, Mr. Zachary Curtis was recently appointed. Mr. Curtis filed a motion to continue.

Judge Kaleb Cockrum granted Mr. Curtis' request to continue Hutson's preliminary since Deputy District Attorney Carolyn Schaffer agreed that four weeks was a reasonable request due to voluminous discovery.

The discovery includes 20 supplemental reports, digital evidence, cell phone downloads and witness statements.

Hutson and Ian Pease's cases were consolidated. Pease's has not waived his 60 day requirement. Ms. Kathleen Bryson represents him. The case may be dismissed against Pease if it does not proceed on March 1.

3/1 update:  Pease entered a time waiver. Preliminary for both defendants is on April 1.
