Naked selfies, period sex, deleted Facebook accounts covered during the first day of Patrick Marshall preliminary hearing

 

Preliminary hearing for alleged molestor Patrick Marshall was scheduled for February 16. Marshall waived his right to a continuous preliminary hearing  so that it could start today. Judge Kelly Neel presided over the hearing.

Marshall is out of custody and still working.

Deputy District Attorney Carolyn Schaffer is the prosecutor for the case. Deputy Public Defender Casey Russo is Marshall's attorney.

Marshall is charged with two counts of unlawful sexual intercourse in violation of PC 261.5 (d), one count of distributing or showing pornography to a minor in violation of PC 288.2 (a) (2) and two violations of PC 288 (c) (1), lewd and lascivious acts with a minor.

Defense had made an offer to plead to PC 261.5 (d). People had made an offer to plead to PC 288 (c) (1). Both offers would have placed Marshall on probation. The People's offer expired with the commencement of the preliminary hearing. 

Fortuna Police Department Detective Ryan Richardson is the only People's witness for alleged molestor Patrick Marshall's hearing.  The defense had him identify some exhibits during cross examination.

As the preliminary progressed, both on direct and cross examination, questions about what exactly happened, issues with what Jane Doe and Marshall told law enforcement as well as what will be substantiated with Facebook messages and other evidence may not be answered unless this case goes to jury trial. Details from the preliminary hearing are posted in a separate post. 

The preliminary hearing will continue tomorrow afternoon.
