The People use the defense strategy in the Ray Christie case and turn the tables

The defense has served many last minute motions to the People and this time, looks like the People beat them to the punch.

About 45 minutes ago, the District Attorney's office served Larson Law Firm with a courtesy copy of the People's motion to continue in the Ray Christie case.

Deputy District Attorney Steven Steward's in declaration states:

"I, Steven M. Steward, declare as follows: 

1. I am a Deputy District Attorney for the County of Humboldt, licensed to practice law in the State of California. 

2. I am assigned to the above-entitled case, which is set for trial setting on Monday, May 9, 2022. 

3. On the afternoon of Monday, April 25. 2022, defense counsel submitted a 335-page motion with exhibits, asking this court to relitigate issues previously decided by this honorable court and Judge Wilson. 

4. The People were given eight days to respond to the defendant's motion, which includes declerations from multiple alleged witnesses that were never called in the first trial or previously mentioned by the defense in the four year pendency of this case.

5. The People respectfully ask this court for an additional 30 days to respond to this lengthy motion that will require addition investigation and potentially multiple interviews by law enforcement. 

6. The defendant has entered a general time waiver in this matter. Therefore, the People respectfully request a continuance. I declare under penalty of perjury that the foregoing is true and correct to the best of my knowledge and belief."

Mr. Stephen Larson is Christie's attorney of record in the system but Mr. Rick Richmond has been making most of the appearances. I contacted Mr. Richmond.

Referring to point 4 in Mr. Steward's declaration, Mr. Richmond said, "That is just wrong. In late December 2021, we made proper disclosure about these witnesses." Mr. Richmond said they gave the People a witness list and a brief explaination of what each witness was going to say.

I asked him if the People knew about Darrell Christie claiming he owns two of the cows and Mr. Richmond acknowledged that information was not disclosed to the People.
