Sergio Reynoso-Lozano was arrested yesterday by HCSO on a warrant. Reynoso-Lozano was booked for PC 288 (c) (1) lewd act against a 14 or 15-year-old child if the defendant was at least 10 years older at the time, PC 288 (a) lewd or lascivious act with a minor under 14 years of age years and PC 667.61(a), a sentencing enhancement for certain sex crimes if committed under specific aggravating circumstances.
This is the first time I have seen this enhancement at booking. Bail is $750,000.
Depending on the details of case, this sentencing enhancement can increase a prison sentence by 15 years, 25 years or life. Some examples:
Per PC 261, If the defendant has a prior rape conviction and is convicted of rape, the sentence can be increased 25 years to life.
Per PC 289, a conviction of sexual penetration can be extended 25 years to a life if the defendant tortured the victim.
Per PC 286, a sodomy conviction can lead to an additional 15 years if the defendant also kidnapped the victim.
