There have been continuances after continuances in Alderpoint homicide suspect Jake Combs' case. This morning was no different. After hearing arguments from both attorneys on yet another defense motion, Judge Kaleb Cockrum continued ruling on the motion until 5/4.
The victim Trevor Earley was 25 years old when he was murdered. Earley's family and friends were in court as they have been for every hearing. Deputy District Attorney Whitney Timm spoke with them a couple of times.
Deputy Public Defender Ben McLaughlin told Judge Cockrum, "Ms. Timm are scheduled to begin the Matthew Dickerson trial on Wednesday. Ms. Timm is in another jury trial. Ms. Timm provided the DNA report. I requested bench notes for analysis. When I see that, I may retain a DNA expert.
Ms.Timm said that the bench notes will be provided today. "I asked Mr. McLaughlin months ago if he intended to hire a DNA expert." The current trial Ms. Timm is in is expected to end today or tomorrow. Dickerson could resolve, it has not started. "The information as stated does not constitute good cause."
Judge Cockrum said he agreed with Ms. Timm about Dickerson but he alao agreed with Mr. McLaughlin. "DNA is a big part and hiring DNA experts could take time." Mr. McLaughlin said he was happy to "trail the motion" and after receiving bench notes today, he will have a decision whether he intends to hire an expert.
5/4: Motion to continue granted. 5/8 date vacated. Trial confirmation 7/11; jury trial 7/24.
