Earlier this month, I reported local attorney Michael Acosta's Faretta motion was granted. According to his court appointed attorney, Ms. Rebecca Linkous, she only agreed to Acosta representing himself for the 995 motion. The Faretta motion granted by the court and all subsequent motions have Acosta listed as his own attorney.
Acosta's first attempt at filing the 995 was rejected due to a technicality. His second attempt at the 995 was successful. The hearing on the 995 motion is scheduled on May 19 in front of Justice Stuart Pollak. He is an Associate Justice of the California First District Court of Appeal. A motion to compel discovery was rejected due to incorrect date and time.
Acosta's co-defendant Sarah Carroll is represented by Ms. Andrea Sullivan. There is no 995 listed in Carroll's case.
I was the only one to follow up and cover what happened to all others arrested with Acosta and Carroll in 2020. You can access those posts via the search feature on this blog.
I have added some excerpts from the very lengthy motion. Deputy District Attorney Ian Harris is the current prosecutor on the case. Former Deputy DA Jane Mackie is no longer employed with the Humboldt DA's office. Former HCSO Deputy Matt Tomlin left the Sherrif's office and works at St. Bernard's.
