Remember double homicide suspect Russell Albers?  He is still in custody. The preliminary hearing has not happened yet.

Today, Judge Kelly Neel told Deputy Public Defender David Nims that his order to show cause and subpoena on WINCO was not properly served. Judge Neel refused to impose sanctions requested by Mr. Nims. After Deputy District Attorney Luke Bernthal and Mr. Nims spoke with Judge Neel at the bench, future dates of pre trial on 8/16 and preliminary hearing on 9/14 remain as scheduled.

There is no information or document in e court and from the brief discussion in court, it seems the defense feels that WINCO is not in compliance with a subpoena.
