Injured juror in sexually violent predator's case causes loss of a week's deliberation and the process starts over with alternate

 


Jurors have been deliberating since last Tuesday on a mental health petition in sexually violent predator Donald Lilly case. He was in court today dressed in a red jumpsuit which means he is in admin segregation. 

This morning, Judge Timothy Canning told Deputy District Attorney Whitney Timm, Conflict Counsel Supervising Attorney Meagan O'Connell  and Lilly that a juror had sustained an injury. He said they could wait and see if the female juror was better tomorrow and have deliberations continue or pick an alternate and deliberations would resume wheb the alternate would get there. When a juror is substituted, deliberations start all over again. The attorneys chose to have an alternate substitute for the injured juror.

5/9: There was a mistrial declared today in Lilly's case. This one day after an alternate was substituted for an injured juror. The jury was "hopelessly deadlocked", thanked and excused.
