Mistrial declared in 3 cases making three losses for DA in two days and three wins for public defenders

 


Travis Lee Gall was charged with a one misdemeanor count of PC 243 (e) (1) domestic battery in a 2023 case. The complaint was filed by the DA on April 7. Yesterday was Day 5 of the jury trial. This included jury selection, evidence and deliberation. There was a mistrial declared yesterday by Retired Judge John Feeney. 

The jury was hung with 1 not guilty vote and 11 guilty votes. Deputy District Attorney Jessica Acosta is the prosecutor. Deputy Public Defender Melanie McNeely is Gall's attorney. New dates were scheduled. Trial confirmation for 5/22 and jury trial for 5/30.

There was a mistrial declared in alleged Matthew Dickerson's case yesterday. I just did a post on that case on April 28 and have added details to the post. In the Dickerson case, defense motion to dismiss was denied. A mistrial was declared due to late discovery. The mistrial was granted because defense refused curative measures. The Court ruled that the lateness was an oversight and not intentional.

As I was writing this post, there was a mistrial declared in sexually violent predator Donald Lilly's case. This one day after an alternate was substituted for an injured juror. The jury was "hopelessly deadlocked", thanked and excused. I did a post on Lilly yesterday and have added this update to that post.

5/22: By stipulation 5/30 date vacated. Disposition reset  on 11/22/23.
