Yesterday was trial confirmation for alleged molestor Kevin Dikes. Conflict Counsel Supervising Attorney Meagan O'Connell's motion to compel and motion to continue jury trial were both granted by Judge Kelly Neel.
The alleged victim's are John Doe 1 who was 9 years old at the time of the incident at Dikes' residence on I street in Arcata. John Doe 2 was 10 years old when the allegations were disclosed and that incident took place in Crescent City.
At Dikes' preliminary hearing, according to testimony, he told one alleged victim's father that he would tell John Doe 1, "I am sorry for touching his nuts."
June 5 date was vacated. Trial setting is on 7/13. Deputy District Attorney Whitney Timm is the prosecutor. Ms. Timm told Judge Neel she is currently in another jury trial. That is for alleged molestor Sergio Reynoso-Lozano.
Judge Neel met with attorneys in chambers. On record, Ms. O'Connell was told to file paperwork with John Doe 1's name redacted. Ms. O'Connell apologized. Ms. Timm learned for the first time in chambers about CWS and John Doe 1 and why Ms. O'Connell wanted two previous CAST interviews. One was conducted in 2017 with Arcata Police Department being the investigating agency; the other in 2017 by the Humboldt County Sheriff's Office. These agencies are not the "people's investigators" and the recordings are not in the DA's possession so Ms. Timm will have to request them.
In my last post, I wrote about defense's request for release of records of a juvenile file. The request about CWS and CAST interviews came after that request by Ms. O'Connell.
