In 2021, I did a post stating Kimberly Felder's case seemed to have disappeared into thin air. In June 2018, Felder was found not guilty by reason of insanity. She pleaded no contest to attempted murder and the special allegation of inflicting great bodily injury. The victim is her daughter.
There was no reason or time to follow up and there certainly is not a shortage of court cases and news to cover. I saw the case on calendar on 5/11. The setting of hearing on the defense PC 1026.2 motion was continued to 7/27. The CONREP outpatient report is due on 7/17.
Deputy District Attorney Emily Norgaard appeared on the case for the People. Deputy Public Defender Ben McLaughlin for Felder who is still at the State Hospital.
Judge Kelly Neel, Judge Kaleb Cockrum and Judge Steven Steward have all recused themselves.
7/27: Setting of hearing on PC 1026.2 continued to 8/10 because Mr. McLaughlin wants additional time.
8/10: Another continuance by defense to 9/7.
9/7: Case was on for setting of hearing on PC 1026.2. Pre trial scheduled for 10/4. PC 1026.2 hearing on 10/16.
10/4: Trial assignment calendar on 10/13; PC 1026.2 hearing scheduled for 10/16.
10/13: Hearing confirmed.
10/16: Felder appeared via Zoom from Napa State Hospital. She looks different, spoke clearly and understood what was going on. Scheduling was discussed. Witnesses include two doctors. October 19 and October 20 dates were discussed. Dates to be confirmed after confirming with court operations staff. PC 1026.2 Mental Health Diversion hearing continued to 10/19.
10/19: After the first day of the hearing, Mr. McLaughlin told me withdrew the petition because if it was unsuccessful, Felder would have to wait another year.
