Local attorney Michael Acosta's Faretta motion was granted on May 3. After two court appointed attorneys, Acosta is back to representing himself in his 2020 case when he was arrested with several others by the Humboldt County Drug Task Force on alleged drug charges. Ms. Rebecca Linkous who is the second court appointed attorney told me that the Faretta motion is only for the 995 motion Acosta filed which was rejected due to a technicality and he refiled on 5/5 but no date has been set in e court.
In California, defendants have the right to waive their right to counsel and represent themselves in a criminal trial. When a Faretta motion waiver is granted by a judge, it allows a defendant to represent themselves in pro per.
After both Acosta and his co-defendant Sarah Carroll were held to answer to charges in their preliminary hearing, the DA added two more counts for the jury trial. Ms. Andrea Sullivan is Carroll's attorney.
Count 1 is HS11366, operating or maintaining a drug house. Count 2 is HS 11351 possession of drugs for sale. Count 3 is HS 11375 (b) (1), possession of controlled substances. Count 4 HS 11377 (a), possession of meth for personal use. Count 5 BS 4060,possession of medication without a prescription.
