Allen McCloskey lawsuit against HCSO and DHHS for ICWA violations moved to federal court

 


Last month, I reported that the lawsuit filed by Allen McCloskey lawsuit against HCSO and DHHS for ICWA violations, malicious prosecution and other causes of action. This morning I received a press release from Ner-Er-Ner Family Village which had also been emailed to Fifth District Supervisor Steve Madrone and Mr. Nick Kloeppel who has been retained to represent the County.

The County defendants are being represented by Mr. Nicholas Kloeppel. A notice of removal of action from Humboldt Superior Court to the U.S. District Court for the Northern District of California was filed yesterday. That request seems to be granted according to Humboldt Superior Court records. The County defendants are asking for a jury trial.


7/10: Case moved to federal court. Local case dismissed without prejudice. McCloskey was not present.
