Waterfront explosion suspect starts pleading to a probation violation while his attorney is trying to get him on supervised release


Waterfront explosion suspect Darin Vitolo's Marsden hearing was denied. Today, all his cases were on the trial assignment calendar.

Judge Gregory Elvine-Kreis told Vitolo," Of no fault of your attorney and over his objection," the jury trial for April 5 would be reset. No courtrooms were available.

As I posted yesterday, it was confirmed "a third court" is available. Many cases are being assigned and trailing.

Right after Deputy Public Defender David Celli said Vitolo had served time on his probation violation and was discussing his custody status, Vitolo piped up, "I am pleading to a probation violation."

Fortunately, Mr. Celli stepped in and stopped Vitolo from talking further, making a rash decision decision and once again screwing things up for himself. 

Mr. Celli told Vitolo that a hearing was scheduled next week to discuss his no bail warrant and if he would be eligible for supervised release. Mr. Celli told Vitolo depending on the outcome of that hearing, they could discuss matters including if Vitolo still wanted to plead to the probation violation. 

OR/bail hearing is on April 6. Trial assignment is scheduled for April 30; jury trial on May 3.
