Why oppose a continuance for a jury trial unlikely to proceed?


Alleged molestor Patricio Segura's jury trial was scheduled for August 12. On August 7, there was a hearing on a motion to continue filed by Deputy Public Defender Brie Bennett.

Additional information was provided to Ms. Bennett just last week and defense investigation will not be completed by Friday. Since this is a "lifetop case" if Segura is convicted, the defense investigation is crucial.

Deputy District Attorney Trent Timm appeared on this case for Deputy DA Stacey Eads. The DA's office is opposing the continuance. The ruling was delayed so a written opposition can be filed and the alleged victim, Segura's daughter can be notified.

This is not Mr. Timm's case, he is just conveying Ms. Eads' instructions. Ms. Eads has certainly requested several continuances in the past for sexual molestation cases. Segura is not going anywhere, he is in custody.

Segura's continuance will be granted for good cause. This is an unneccessary opposition that will only waste court time and resources. Since an interpreter is needed, that is an additional factor.

The ruling on the motion to continue has been continued to tomorrow at 8:30 as well Friday at 9:15 when the case is already scheduled for trial assignment. Several not time waived cases are a priority before Segura and it is unlikely that this jury trial will proceed on August 12, even before the motion to continue was filed.

Certified Spanish court interpreter Mr. Carlos Benemann translated the proceedings for Segura. Mr. Benemann is also a certified German court interpreter.

8/8/2019 update:

Defense motion to continue the jury trial was denied on 8/8/19. Some additional information was needed and on 8/9 the defense motion was granted. The August 12 date was vacated. Trial setting is on August 14.

Deputy District Attorney Whitney Timm was in court for the People. Deputy Public Defender David Celli appeared in court for Ms. Bennett.
