I predicted this last minute motion to continue in alleged molestor Michael Franco's case


A predictable move and pattern by Mr. Russ Clanton who is alleged molestor Michael Franco's attorney. I had mentioned to a few people at the courthouse that there would be a motion to continue, at the last minute and there was one filed by the defense on 8/28/19.

On August 22, the trial date was confirmed but there was also a on order requested for Dr. Renouf to have jail access to visit and evaluate Franco.

The motion was heard at trial assignment this morning. Jury trial scheduled to start on September 3 was vacated. Motion to continue was granted by Judge Kaleb Cockrum for good cause. Setting is scheduled for September 12.

Mr. Clanton told Judge Cockrum that there were witness interviews referenced in his pleadings. He had difficulty contacting witnesses in Los Angeles but was able to contact one witness. Mr. Clanton mentioned jail calls which are important and that while his funding order for an expert was granted, he needed more time to review electronic data, including a photo.

Deputy District Attorney Stacey Eads said the People opposed the continuance. The victims are entitled to a speedy resolution. "The jail calls were generated by the defendant himself. A situation he created himself."

"I realize Mr. Clanton needs to investigate to represent his client," said Ms. Eads.

Judge Cockrum asked if the People intended to use the photo at trial. Ms. Eads said, "Absolutely."

Judge Cockrum said that jail calls could be a resdon for a "perpetual continuance." Judge Cockrum granted the continuance because of the photo and discovery.
