Seng Yang's wife enters into an immunity agreement with the People, jurors can use it in evaluating her testimony



Seng Yang's wife Kristy Lee was recalled to the stand. With her was her court appointed attorney, Conflict Counsel Supervising Attorney Meagan O'Connell.

Lee hemmed and hawed just as her previous testimony.

Even when she answered, "I don't know" or I can't recall, Lee's testimony corroborated Jane Doe's testimony. In my previous post about her testimony, I mentioned she met with an attorney.

Lee showed no emotion, no remorse and no concern for Jane Doe.

Ms. Eads asked Lee what actions she took "in response to having found your daughter and your husband in your daughter's room?"

"I didn't know how to respond. I'm hoping she will talk to me."

Lee acknowledged she did nothing and she did not try and talk to Jane Doe. Lee identified photos of Jane Doe's bedroom. These were taken the day Yang was arrested.

Exhibit 45 was shown to the jurors. It showed the desk in the room. When Lee walked into the room in the middle of the night, Jane Doe was on the bed; Yang behind the desk.

"He was standing behind the desk," said Lee.

Ms Eads: "What was he wearing?,"

"I was so shocked, I can't tell. The look on their faces, they were surprised to see me." She stated again that Jane Doe was sitting on the bed and wearing an oversized sweater/hoodie.

"That night I didn't want to talk to nobody, I was so upset," said Lee.

Ms. Eads: "Why were you upset?"

"I don't know," said Lee.

Ms. Eads: "Is it that you don't know or you don't want to say?"

"I don't know," said Lee.

Ms. Eads: "Were you mad at Jane Doe when you found her and your husband in Jane Die's room?"

"I don't think I was mad at her," said Lee.

Ms. Eads asked Lee about her conversation with EPD Sr. Det. Ron Harpham.

"Yes because they were together in the same room. I thought they were doing something. But, I didn't see them in the act."

Ms. Eads asked about her conversation with Det. Harpham and her statement about "you caught your husband and daughter" and "were you under the impression they were engaging in sexually inappropriate behavior?"

Lee responded with,," I wasn't sure", "I don't know" and"I didn't catch them in the act." Regarding Yang not wearing any clothing,Lee said, "I don't believe he was."

Lee confirmed Jane Doe's testimony that an uncle came to visit in late 2017 and added he was there until the day Yang was arrested. She said he helped Yang look for the girls on January 5,2019. She also confirmed the hotel visit in Fresno and the sleeping arrangements.

This morning before her cross examination Judge John Feeney shared with the jurors that Lee had "entered into an immunity agreement  with Ms. Eads and the People last Thursday." Judge Feeney read a jury instruction about credibility of a witnesses. This immunity agreement is a factor that can be considered by jurors to evaluate Lee's credibility and testimony.

During cross examination, Lee essentially repeated her direct testimony. The only new information was that Lee said she never saw bruising or marks caused by hitting on Jane Doe.
