On Day 2, misdemeanor jury trial dismissed because alleged offense took place in Del Norte County


On Day 2 of a jury trial today in Courtroom Two in Humboldt Superior Court, the case was dismissed.



PC 1385:
"(a) The judge or magistrate may, either of his or her own motion or upon the application of the prosecuting attorney, and in furtherance of justice, order an action to be dismissed.  The reasons for the dismissal shall be stated orally on the record. "

    SO who in the court system had their head up their -ss and let this go ahead when it should have been found immediately and rejected/forwarded????? Is our court that dumb???

    Over the peoples objection... Sounds like the Prosecutor was in disagreement with the witness testimony. Wipe egg off face, next case.
