Alleged molestor Ralph Horn takes the People's offer, will he get three years or probation?


Ralph Horn arraignment on information was continued to this morning. Charges for jury trial include the three counts of sexual battery Horn was held to answer to after the preliminary hearing and the addition of a special allegation of a prior conviction.

The arraignment was continued so Deputy Public Defender Owen Tipps could discuss an offer with Horn. That offer by the People would expire once Horn is arraigned. DA Maggie Fleming appeared for the People since Deputy DA Carolyn Schaffer is out on leave.

Horn entered a plea to Count 1. The rest of the charges were dismissed. The plea deal is for a "mid term cap" of three years if Horn does not get probation.

Jane Doe was informed of the resolution by Ms. Schaffer and agreed to the plea.

No Arbuckle waiver was entered. Sentencing is on June 6. Judge John Feeney took the plea today and referred the case to probation for a pre-sentencing report.
